機場捷運之機場第一航廈站(A12)及機場旅館站(A14a)無償撥用國有土地持分案辦理情形 Implementation Progress of Appropriation of National Public Land without Compensation Case of Airport Terminal 1 Station (A12) and Airport Hotel Station (A14a)

為興辦「臺灣桃園國際機場聯外捷運系統建設計畫」桃園國際機場路段之機場第一航廈站(A12)及機場旅館站(A14a)等車站用地需要,無償撥用交通部民用航空局管有桃園縣大園鄉中正段139、140、256、264、266、267地號等6筆國有持分土地(持分面積7688.48平方公尺),辦理情形分述如下:
(一)交通部97年10月28日召開研商「臺灣桃園國際機場聯外捷運系統建設計畫」修正計畫經建會審議意見會議,有關議題一之結論(2)略以「請民航局專案報請行政院辦理減帳後,由高鐵局以無償撥用取得」。
(二)交通部99年6月9日陳報行政院,請准由民航局辦理減資(折減基金),案經行政院99年8月20日原則同意。經查A12及A14a車站擬撥用土地持分面積0.768848公頃,截至100年度帳面金額7,302萬9,056元。
(三)99年10月7日雙方會議達成共識,機場捷運A12、A14a車站用地撥用作業延至101年由民航局併預算編列辦理減資後辦理。因當時車站工程均已進行施工,對營運、預算編列等事項亦無執行困難之處,由本局配合上開時程辦理撥用。
(四)為符土地管用合一,避免日後管理使用困擾,本局102年9月17日檢送撥用不動產計畫書,經該局103年3月24日函覆原則同意,並檢附民航事業作業基金數額增減明細表乙份供本局續辦陳報事宜。
(五)103年5月12日代辦部稿檢送無償撥用不動產計畫書予財政部國有財產署轉陳行政院准予辦理,103年5月22日行政院核准辦理,桃園縣蘆竹地政事務所於103年6月10日完成管理機關變更登記為本局管有。

To fulfill the land usage demand of TIAA MRT Project stations including Airport Terminal 1 Station (A12) and Airport Hotel Station (A14a), the appropriation of public land without compensation from Civil Aeronautics Administration (CAA), MOTC was conducted. The 6 national ownership portion lands (total area 7688.48 m2) included Land No.139, 140, 256, 264, 266, 267 of Chungcheng Section, Dayuan Township, Taoyuan County. Implementation progresses and records are as follows:
1. On Oct. 28, 2008, MOTC launched the "CEPD Evaluation Meeting of the TIAA MRT Project Amendment Plan". Regarding Topic 1, Conclusion 2: CAA should submit the plan to Executive Yuan for price reduction and BOHSR shall proceed with appropriation of public land without compensation.
2. MOTC submitted the request of CAA capital reduction case on Jun. 9, 2010 to Executive Yuan and agreement in principle of the case was proclaimed on Aug. 20, 2010. A12 and A14a Station ownership portion lands were added up to 0.768848 Ha and was valued NT$ 73,029,056 from 2011's record.
3. On Oct. 7, 2010, both parties reached consensus that the appropriation process of A12 and A14a station lands to be postponed to 2012 after CAA conducted capital reduction and budgeting. As the station construction will commence at that time, and operational and budgeting obstacles will then be removed, BOHSR will then proceed with appropriation in 2012.
4. In accordance to the policy of land operation and management consistency and to avoid future possible confusions, BOHSR submitted Appropriation of Real Estate Plan on Sep. 17, 2013 and agreement in principle by CAA was proclaimed and returned back to BOHSR on Mar. 24, 2014. Additionally, the CAA Operating Fund List was also attached for subsequent processes.
5. The Appropriation of Real Estate Plan was submitted to Executive Yuan via National Property Administration, MOF on May 12, 2014. The Plan was approved on May 22, 2014 and the management authority was officially registered as BOHSR by Lujhu Land Office, Taoyuan County on Jun. 10, 2014.
