In the original design of TIAA MRT constructions from Sanchong Station to Taipei Main Station, elevated routes were adopted. However, due to enduring urban planning and the appearance of our capital, Taipei City Government (TCG) proposed to adopt underground system for this section in which MOTC accepted the proposal. In 2005, MOTC entrusted TCG to execute designing, land acquisition and construction of civil engineering and E&M engineering of TIAA MRT System for this certain section. In the signed TIAA MRT Administration Contract, TCG agreed to unconditionally transfer ownership of operational facilities, the land of TIAA MRT System and the integrated structures to MOTC after completion of the construction project.
Regarding the land ownership issue, during initial land acquisition executed by TCG, the executive unit registered the ownership of project land as "Taipei City" and administrative authority as "Department of Rapid Transit Systems (DORTS)". Due to different level of ownership, the ownership of land could not be successfully transferred from a city-owned entity (TCG) to a national entity (MOTC) after project construction. Thus, the mutual agreement of land transfer in the contract could not be fulfilled which led to controversial issues in land use benefits. In response to this matter, MOTC covered additional costs concerning this transfer due to the entrustment nature of this case and in accordance to the fulfillment of the TIAA MRT Administration Contract, the registration of land was revised to "Republic of China" on Aug. 21, 2014 with approval from the Executive Yuan. In addition, the Executive Yuan instructed that such land acquisition cases funded by central government entities shall be registered under the central government entity to avoid future land transfer controversies.
Owing to construction demands for TIAA MRT Taipei Main Station (A1) and the tunnel sections, BOHSR applied for appropriation of public land with compensation to TRA including Land No. 211-7 in Gongyuan Section, Zhongzheng District and Land No. 365-8, 366-8, 371-33, 371-34, 371-36, 371-38, 371-45, 650-2 in Yuquan Section, Datong District. In accordance to commands given out by the Executive Yuan, BOHSR will report to MOTC who will submit application to Executive Yuan and the ownership of public land will be registered as "Republic of China" under administrative authority of BOHSR.
