第三人申請公益使用機場捷運用地案例- 機場捷運泰山站(A5)及泰山貴和站(A6)新建候車亭工程 Case of Providing Land of TIAA MRT For Public Interest - New Shelter Construction at TIAA MRT Taishan Station (A5) and Taishan Guihe Station (A6)

新北市政府交通局為配合機場捷運通車,及改善搭乘機場捷運旅客流量增加所造成交通擁擠問題,並鼓勵民眾使用大眾運輸交通工具,於機場捷運泰山站(A5)及泰山貴和站(A6)新建候車亭,提供民眾良好的候車環境,並充分發揮機場捷運用地使用價值。
為辦理該項工程,該局檢送申請書、土地使用計畫書、興建及管理計畫書,申請使用本局管有新北市泰山區泰山段1小段723地號及3小段735地號等2筆機場捷運用地,使用面積24.8平方公尺。所涉大眾捷運系統兩側禁限建範圍建築行為申請,經技術單位審核對於機場捷運設施及行車安全無影響,及交通部核復原則同意,且符合「國有公用財產無償提供使用之原則」第4點規定,本局同意無償提供使用,於105年3月簽訂土地使用合約書。
後續該局須依合約書及審查同意之土地使用計畫書、興建及管理計畫書等內容使用管理土地,並負責設施之興建、使用及維護管理之義務,隨時保持相關設施品質及安全,維護土地完整。

To improve the traffic congestion situation due to increasing loading of the TIAA MRT System and to encourage the use of public transport vehicles, the Transportation Department, New Taipei City planned to construct new waiting shelters at Taishan Station (A5) and Taishan Guihe Station (A6) in accordance to the opening of the TIAA MRT System. The shelters are aimed to provide people with a comfortable waiting environment and give full play to the land use value of TIAA MRT.To implement the project, the Transportation Department has submitted the application form, land usage project proposal and the construction & management proposal to BOHSR to apply for 2 lots of TIAA MRT land including 1 subsection of Lot 723 in and 3 subsection of Lot 735 in Sec. Taishan, Taishan District with a total of 24.8 square meters. As this project is within the scope of the construction of the building restriction area, technical units of BOHSR has evaluated the project and determined that the construction will not endanger the facilities and operational safety of the TIAA MRT. MOTC also reviewed the matter concluding with agreement in principle. Additionally, it is in line with Article 4 of the “Principle of Providing National Public Property For Public Interests” so BOHSR agreed to provide free use and signed a land use agreement in March 2016.
Subsequently, the Transportation Department will manage the land in accordance with the contract, the land usage project proposal and construction & management proposal that have been evaluated and approved. The department will also be responsible for the construction, usage and maintenance management of the facilities, maintaining quality and safety of the facilities, and integrity of the land.
