臺中市大雅區下員林段高鐵用地協議價購 Purchase Negotiation of right-of-way of HSR in Xiayuanlin Section, Daya District, Taichung City


The right-of-way of HSR in Xiayuanlin Section, Daya District, Taichung City (south side of Zhongqing Road) was expropriated by BOHSR in 1996 from cadastral segmentation survey results according to Ya-Tan Land Office, Taichung City. In 2015, Ya-Tan Land Office re-applied for expanded cadastral survey, and in the same year held a briefing on Sep. 23. In the briefing, the land office indicated that the land is located between the two sections and the adjacent map segmenting data is wrong, so it did not match the original cadastral segmenting survey in 1996. Therefore, cadastral segmenting correction for this section has to be re-applied. Following, BOHSR implemented land acquisition for the two lots, respectively Lot No. 235-97 and 235-265, Xiayuanlin Section, to protect the rights and interests of the land owner and also maintaine the integrity of right-of-way for HSR.
Based on Article 11 of Land Expropriation Act, “Before applying for land or land improvement, the applicant shall agree with the landowner on the market price”, BOHSR respectively held land purchase negotiation meetings with the land owners on Aug. 4, Oct. 12 and Nov. 10, 2016. On Aug. 4 and Dec. 16, 2016, both parties reached an agreement to purchase and transfer property rights of the land lots.
1、As lot No. 235-265 is a farmhouse construction base, the lot must first lift its agricultural land control before the transfer of property rights registration. After the lift of agricultural land control on Feb. 13, 2017 by Urban Development Bureau of Taichung City Government, the transfer of property rights registration took place on Mar. 3 and the purchase payment was completed on Mar. 16.
2、As for land lot 235-97, the land owner pleaded that the two lots of land were mistakenly moved onto the road due to cadastral inspection by Ya-tan Land Office. BOHSR helped to identify that the Yantan cadastral survey only clarified HSR usage land and there is no land boundary situation described by the land owner. After lifting the land owner's doubts, the transfer of property rights registration took place on Apr. 24 and the purchase payment was completed on May 8.
