鄰捷運施工管制及審查作業基準研析過程 Process of Analyzing the Evaluation and Operational Standards for Control of Proximity Construction Adjacent to the MRT

目前台北捷運、高雄捷運、台中捷運及機場捷運依據大眾捷運系統兩側禁建限建辦法進行於捷運兩側禁建限建範圍內之開發案件(以下簡稱列管案件)審查。在禁建限建辦法中對輕軌的法規條文無法適用,無法據以執行列管案件的審查。而機場捷運亦已於106年通車營運,列管案件審查工作將越來越多,亦衍生委託外部專業機構審查之需求,為維護捷運設施的安全,修訂禁建限建辦法及制定捷運兩側禁建限建列管案件之審查作業基準,實為刻不容緩的工作。
「鄰捷運近接施工管制及審查作業準則(草案)」研訂委託技術服務案業於105年12月22日決標,得標廠商為台灣世曦工程顧問股份有限公司,服務內容包括現行捷運禁建限建辦法執行檢討、蒐集國外相關鄰近捷運(含輕軌)施工辦法案例,辦理2次專家學者座談會,蒐集產官學各方建議與意見後提出「鄰捷運近接施工管制及審查作業準則(草案)」及「研擬修訂大眾捷運系統兩側禁建限建辦法部分條文構想、總說明及相關條文(含解說)」期末報告成果,亦經臺北市、新北市、桃園市、臺中市、高雄市等捷運主管機關參與審查會2次討論完成研究成果,於107年1月8日函報交通部審定。
鄰捷運近接施工管制及審查作業準則草案,本局業依交通部函示「作業準則」修正為「作業基準」,並以交通部107年2月8日函將「鄰捷運施工管制及審查作業基準」送各地方政府供參。另大眾捷運系統兩側禁建限建辦法部分條文修正(草案)交通部刻正進行審查程序,待審定頒行後,有助於增進公共工程於捷運(含輕軌)兩側禁建區推動之彈性。

Currently, Taipei Metro, Kaohsiung MRT, Taichung MRT and the TIAA MRT are all evaluating the developing projects within the MRT restriction areas (will be referred to as “monitored cases”) according to the “Regulations for the Scope of Restrictions and Permit Bans alongside the Mass Rapid Transit Systems”. The articles for light rail are not yet complete in the abovementioned regulation so it will not be able to be applied to some of the monitored cases. Moreover, with the opening of TIAA MRT in 2017, the workload for evaluating monitored cases will increase tremendously as well as additional demands for third-party evaluations by designated professional organizations. Therefore, revising the “Regulations for the Scope of Restrictions and Permit Bans alongside the Mass Rapid Transit Systems” and establishing the evaluation standards for monitored cases should be conducted with no delay for the safety of MRT facilities.
The assigned technical service case of “Evaluation and Operational Guidelines for Control of Proximity Construction Adjacent to the MRT (draft)” was won by CECI Engineering Consultants Inc. on Dec. 22, 2016. The contents of the project included execution and evaluation of the existing building permit bans and restrictions alongside the MRT system, integration of cases of construction regulations adjacent to MRT (including Light Rail) in foreign countries, hosting 2 specialists & academics forums, collecting suggestions and comments from industrial, governmental and academic fields and proposing the “Evaluation and Operational Guidelines for Control of Proximity Construction Adjacent to the MRT (draft)” and establish the report for “Revision of the structure of partial articles, general description and related articles (including annotations) of Regulations for the Scope of Restrictions and Permit Bans alongside the Mass Rapid Transit Systems”. The results report was completed after 2 evaluation meetings with the participation of MRT competent authorities from Taipei City, New Taipei City, Taoyuan City, Taichung City and Kaohsiung City and was then submitted to MOTC for further ratification on Jan. 8, 2018.
For the “Evaluation and Operational Guidelines for Control of Proximity Construction Adjacent to the MRT (draft)”, BOHSR has revised the wording “guidelines” into “standards” based on the request from MOTC. Following on Feb. 8, 2018, the “Evaluation and Operational Standards for Control of Proximity Construction Adjacent to the MRT” was sent to local governments for reference under MOTC official letter. As for the “Revision of Partial Articles for Regulations for the Scope of Restrictions and Permit Bans alongside the Mass Rapid Transit Systems (draft)”, MOTC is currently implementing evaluating procedures for the revision. Upon promulgation of the revision, it will help increase the flexibility of promoting public construction in the restricted areas alongside the MRT system (including light rail systems).
